Responsibilities

Responsibilities regarding hazard assessment, elimination and control are outlined in Part 2 of the Occupational Health & Safety Code.

Employer Responsibilities Include:

  • Assessing the workplace and identifying existing and potential hazards before work begins or prior to the construction of a new work site
  • Involving affected workers in the hazard assessment and in the elimination or control of the hazard identified
  • Preparing a dated, written report made available to workers, of the results of a hazard assessment and the methods used to eliminate or control the hazards
  • Ensuring that workers affected by the hazards identified in the report are informed of the hazards and of the methods used to control or eliminate those hazards
  • Repeating the hazard assessment when processes are introduced or changed, before significant alterations to the workplace are made, and on a practicable basis to ensure no unsafe or unhealthy working conditions arise
  • Investigate and eliminate imminent danger (danger that is not normal for that occupation or part of that worker's normal tasks)

Worker Responsibilities Include:

  • Refuse to carry out work if, on reasonable and probable grounds, the worker believes that there exists an imminent danger to the health and safety of themselves or their co-workers
  • Notify employer of their refusal to work and why, and when asked by their employer be a part of hazard assessment, elimination and control
